1. Purpose

This document outlines Gentle Hearts Living Solutions' (GHLS) commitment to compliance with Arizona Revised Statute §36-446.14, which governs the disclosure of referral fees in the senior placement industry. The purpose of this policy is to ensure transparency, maintain ethical

business practices, and inform clients about referral fees that may be collected as part of our services.

2. Statutory Requirement

Arizona Revised Statute §36-446.14 states that any individual or organization receiving compensation for referring individuals to long-term care facilities must:

1. Disclose to the individual or their representative that a referral fee may be paid.
2. Identify the parties involved in the payment of the fee.
3. Provide this disclosure in writing before or at the time a referral is made.

Failure to comply with these disclosure requirements may result in legal consequences, including penalties and disciplinary action.

3. GHLS Compliance Policy

To ensure full compliance with A.R.S. §36-446.14, GHLS follows these best practices:

3.1 Disclosure of Referral Fees

● GHLS may receive compensation from senior living communities, care homes, or other third-party service providers in exchange for successful placements.
● This compensation does not influence placement recommendations. Our primary goal is to match clients with the most suitable care option based on their needs, preferences, and budget.

● GHLS does not charge families for placement services. Fees are typically paid by the senior living community or care home upon move-in.

3.2 Written Acknowledgment

● GHLS provides a written disclosure statement to clients or their representatives before or at the time of referral.
● The disclosure includes:
○ A statement that GHLS may receive compensation for the referral.
○ The amount of compensation in which we may receive.
○ A declaration that the referral process remains unbiased and prioritizes the best interest of the client.

3.3 Transparency and Ethical Business Practices

● GHLS does not require families to select a particular community based on compensation received.
● GHLS representatives are trained to disclose referral fee arrangements during initial consultations and in any marketing materials that discuss placement services.
● GHLS maintains a list of all senior living communities and care homes that may provide referral fees.

3.4 Record-Keeping

● GHLS retains signed acknowledgment forms from clients confirming that they have been informed of potential referral fees.
● These records are securely stored for a minimum of three years, as required by Arizona law.

3.5 Non-Discrimination Clause

● GHLS does not limit placement recommendations based on referral fees. We prioritize the care needs, affordability, and personal preferences of each client.

4. Enforcement and Compliance Review

● GHLS leadership conducts annual compliance reviews to ensure adherence to A.R.S. §36-446.14 and related legal requirements.
● Any employee or agent found violating this policy may face disciplinary action, including termination of their contract.
